Terms of service

These terms apply to marketing services provided by Clients On The Way – Marketing agency Nairobi (“ClientsOnTheWay”, “we”, “us”). The specific scope, price and start date of your service are confirmed in writing before we start.

1. Services

We provide local SEO (including Google Business Profile optimisation, website on-page SEO and citations), Google Ads management and Meta Ads management, as agreed with you in writing.

2. Fees and payment

Monthly fees are payable in advance. Advertising budgets for Google Ads and Meta Ads are paid by you directly to Google or Meta and are separate from our management fee.

3. Term and cancellation

Services run month-to-month. Either party can cancel with notice before the next billing month. Fees already paid for the current month are not refundable.

4. The 90-day ranking guarantee

For our Top 3 on Google service: if your business is not in the top 3 Google Maps results for the main keyword and area agreed in writing within 90 days of the start date, we continue the work at no additional fee until it is, as long as you remain a client in good standing and have provided the access and inputs requested. Rankings depend on Google, which we do not control; the guarantee is limited to continued work as described here.

5. Your responsibilities

You give us the access we need to your Google Business Profile, website and ad accounts, provide accurate business information, and keep ownership of your accounts. We ask you to request reviews from real customers and share photos of your work regularly.

6. Exclusivity

While you are an active client, we will not provide the same service to a direct competitor in the same industry and area.

7. Google’s rules

We follow Google’s and Meta’s guidelines. We do not create fake listings, addresses or reviews, and we will not carry out work that could put your accounts at risk.

8. Liability

We are not responsible for changes made by Google, Meta or other platforms, for account decisions those platforms make, or for results that depend on factors outside our control. Our total liability is limited to the fees you paid us in the three months before the claim.
